1. Acceptance of Terms
Welcome to Golden Hour Studios! By accessing or using our website and services, including renting our photo studios, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services. These Terms and Conditions constitute a legally binding agreement between you and Golden Hour Studios, owned and operated by Stellar Visionaries LLC, located at 123 Main Street, Anytown, USA.
2. Booking and Payment
All studio rentals are subject to availability and confirmation by Golden Hour Studios. A booking is considered confirmed only upon receipt of a deposit or full payment, as specified at the time of booking. We accept various forms of payment, including credit cards, debit cards, and electronic transfers. Payment details are securely processed through our payment gateway provider, ensuring the safety and confidentiality of your financial information.
- A non-refundable deposit of 25% is required to secure your booking.
- The remaining balance is due 7 days prior to your scheduled rental date.
- Late payments may result in cancellation of your booking.
- Pricing is subject to change without notice, but confirmed bookings will honor the rates in effect at the time of booking.
3. Cancellation Policy
We understand that unforeseen circumstances may arise, requiring you to cancel or reschedule your booking. Our cancellation policy is as follows:
- Cancellations made more than 14 days prior to the scheduled rental date will receive a full refund, less the non-refundable deposit.
- Cancellations made between 7 and 14 days prior to the scheduled rental date will receive a 50% refund.
- Cancellations made less than 7 days prior to the scheduled rental date are non-refundable.
- Rescheduling is subject to availability and must be requested at least 7 days prior to the original rental date. A rescheduling fee may apply.
4. Studio Usage
You are responsible for ensuring that the studio is used in a safe and responsible manner. The following rules apply to studio usage:
- Smoking, vaping, and the use of illegal substances are strictly prohibited within the studio premises.
- Food and beverages are permitted in designated areas only.
- You are responsible for cleaning up after your session. A cleaning fee may be assessed if the studio is left in an unsatisfactory condition.
- Equipment must be used according to the manufacturer's instructions. Damage to equipment due to misuse will be the responsibility of the renter.
- Children must be supervised at all times.
- Noise levels must be kept at a reasonable level to avoid disturbing other renters.
- The studio must be vacated promptly at the end of your rental period. Overtime will be billed at the hourly rate.
5. Equipment and Liability
Golden Hour Studios provides a range of equipment for your use. You are responsible for any damage to equipment caused by negligence or misuse. We are not liable for any loss or damage to your personal belongings while on the studio premises. We maintain liability insurance, but it is recommended that you obtain your own insurance coverage for your photography equipment and business operations.
A detailed inventory of equipment is provided upon arrival. Please review this inventory and report any discrepancies immediately. Upon departure, the equipment will be checked again, and any missing or damaged items will be billed to the renter at their replacement cost.
6. Intellectual Property
You retain all rights to the photographs and other content created during your studio rental. Golden Hour Studios does not claim any ownership or rights to your work. However, we reserve the right to use photographs of the studio itself for promotional purposes, unless otherwise agreed in writing.
If you wish to use images of the studio in your portfolio or promotional materials, please credit Golden Hour Studios appropriately.
7. Limitation of Liability
To the fullest extent permitted by law, Golden Hour Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use our services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our services; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; (e) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via our services; and/or (f) the defamatory, offensive, or illegal conduct of any third party.
8. Indemnification
You agree to indemnify and hold harmless Golden Hour Studios, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to our services; (b) your violation of any term of these Terms and Conditions; (c) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your content caused damage to a third party.
9. Changes to Terms
Golden Hour Studios reserves the right to modify or update these Terms and Conditions at any time without prior notice. Your continued use of our services after any such changes constitutes your acceptance of the new Terms and Conditions. It is your responsibility to review these Terms and Conditions periodically for any updates or changes.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts located in Los Angeles County, California.
